1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Apiglot ("Company", "we", "our", "us") governing your access to and use of the Apiglot translation API service, website, and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
2. Description of Service
Apiglot provides a translation API service that enables developers to add multilingual support to their applications. The Service includes:
- API access for programmatic translation requests
- Dashboard for managing translations, API keys, and settings
- SDKs and libraries for various programming languages
- Documentation and technical support
- Analytics and usage reporting
3. Account Registration
3.1 Account Creation
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Account Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3.3 API Keys
Your API keys are confidential and must not be shared publicly or with unauthorized parties. You are responsible for securing your API keys and must notify us immediately if you suspect any unauthorized use.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You shall not:
- Use the Service to translate content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
- Attempt to circumvent any rate limits, usage quotas, or security measures
- Use the Service to process content that infringes on intellectual property rights of others
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use automated scripts to abuse or overload the Service
- Resell or redistribute the Service without our written consent
- Use the Service to develop a competing translation service
- Transmit any viruses, malware, or other harmful code
5. Subscription Plans and Pricing
5.1 Free Tier
We offer a free tier with limited translation volume for evaluation and small-scale use. Free tier users are subject to rate limits and may experience reduced priority during high-demand periods.
5.2 Paid Plans
Paid subscription plans provide increased translation volume, higher rate limits, priority support, and additional features. Plan details and pricing are available on our website.
5.3 Billing
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly set forth in these Terms or required by law.
5.4 Overage Charges
If you exceed your plan's translation volume, additional charges may apply at the overage rates specified in your plan. We will notify you when you approach your limits.
5.5 Price Changes
We reserve the right to modify our pricing with 30 days' notice. Price changes will not affect the current billing period.
6. Intellectual Property
6.1 Our Intellectual Property
The Service, including its original content, features, functionality, and underlying technology, is and will remain the exclusive property of Apiglot and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
6.2 Your Content
You retain all rights to the content you submit for translation ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to process Your Content solely for the purpose of providing the translation service.
6.3 Feedback
Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to you.
7. Data Processing
7.1 Content Processing
Content submitted through our API is processed to provide translation services. We do not use Your Content to train our translation models unless you explicitly opt in to such programs.
7.2 Data Retention
Translation requests are processed in real-time. We may retain logs and metadata for operational purposes, security, and to improve the Service, in accordance with our Privacy Policy.
7.3 Data Processing Agreement
For enterprise customers requiring a Data Processing Agreement (DPA) for GDPR or other compliance purposes, please contact us at legal@apiglot.com.
8. Service Level
8.1 Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.
8.2 Support
Support levels vary by plan. Free tier users have access to documentation and community support. Paid plans include email support with response times based on the plan level.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- The Service will be uninterrupted, secure, or error-free
- Translations will be 100% accurate or appropriate for any specific use
- Any errors in the Service will be corrected
- The Service will meet your specific requirements
You acknowledge that machine translations may contain errors and should be reviewed for accuracy, especially for legal, medical, or other critical content.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL APIGLOT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Apiglot and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your Content submitted to the Service
12. Termination
12.1 Termination by You
You may terminate your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service will immediately cease.
12.2 Termination by Us
We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, we may delete your account data after a reasonable retention period.
12.3 Effect of Termination
Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. Modifications to Service and Terms
13.1 Service Modifications
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance.
13.2 Terms Modifications
We may revise these Terms from time to time. Material changes will be communicated via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
14. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Apiglot is incorporated, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of a mutually agreed arbitration provider.
15. General Provisions
15.1 Entire Agreement
These Terms, together with the Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Apiglot regarding the Service.
15.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
15.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.
